STANDARD TERMS AND CONDITIONS OF SALE

These Terms and Conditions ("T&Cs") govern the sale of goods by us and form the basis of the contract between us and you (“the Buyer”, “you”, “your”). By placing an order through our website, www.serengetiscents.com, you agree to be bound by these T&Cs.

1. General 

1.1. This agreement is governed by and shall be interpreted in accordance with the Laws of Kenya. Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the Kenyan courts. 

1.2. We reserve the right to amend these T&Cs at any time. Any amendments will be effective immediately upon posting on our website.

2. Orders & Acceptance 

2.1. All orders placed by you are an offer to purchase our goods. 

2.2. An order is deemed accepted by us only when we dispatch the goods to you. We reserve the right to decline any order at our discretion. 

2.3. You are responsible for ensuring the accuracy of your order details, including delivery address and contact information.

3. Pricing & Payment 

3.1. All prices are quoted in Kenyan Shillings (KES) and are inclusive of Value Added Tax (VAT) at the prevailing rate. 

3.2. Prices are subject to change without prior notice. The price payable is the price displayed on the website at the time of placing your order. 

3.3. Payment shall be made in full at the time of order. We accept payment via M-Pesa, debit/credit cards, and other payment methods as indicated on our website. 

3.4. Goods will not be dispatched until full payment has been received and cleared in our account.

4. Delivery & Shipping 

4.1. We offer delivery services within Nairobi and to other regions across Kenya. Delivery charges will be calculated at checkout and added to the total order amount. 

4.2. Delivery within Nairobi: We aim to deliver within 1-2 business days. 

4.3. Delivery outside Nairobi: We aim to deliver within 2-5 business days, depending on the destination.

 4.4. While we strive to meet these timelines, delivery times are estimates and not guaranteed. We shall not be liable for any delays caused by circumstances beyond our reasonable control. 4.5. Risk of loss or damage to the goods passes to you upon delivery to the specified address.

5. Returns, Refunds & Exchanges 

5.1. In compliance with the Consumer Protection Act of Kenya, if goods are found to be defective, damaged upon arrival, or not as described, you must notify us within seven (7) days of receipt. We will arrange for a return and offer a full refund or an exchange. 

5.2. For non-defective goods, we may accept returns for an exchange or credit note at our discretion, provided the goods are returned unopened, in their original packaging, and in a resalable condition within seven (7) days of receipt. The Buyer will be responsible for all return shipping costs. 

5.3. Due to the personal nature of our products, we cannot accept returns on items that have been opened or used.

6. Limitation of Liability 

6.1. Our total liability to you for any claim arising out of or in connection with the sale of goods, whether in contract, tort (including negligence), or otherwise, shall be limited to the value of the goods supplied. 

6.2. We shall not be liable for any indirect, consequential, or special losses.

7. Intellectual Property 

7.1. All intellectual property rights, including trademarks, logos, and content associated with "Serengeti Scents" and our products, are the exclusive property of Zenithblend Ventures Limited. Unauthorized use is strictly prohibited.

8. Data Protection & Privacy 

8.1. We are committed to protecting your privacy and handling your personal data in accordance with the Kenya Data Protection Act, 2019. 

8.2. By placing an order, you consent to us collecting and processing your personal data for the purpose of fulfilling your order and for our marketing activities. For more details, please refer to our full Privacy Policy available on our website.
